MAINE BIRTHS, MARRIAGES & DEATHS

The climate and terrain of Maine as well as the resistence of the Native Amercians to colonial expansion kept the European settlers mainly to a few small towns in the south east until the 1700s and Maine was still considered a frontier up to the twentieth century. Even with the arrival in the 1700 and 1800s of many new settlers from Nova Scotia, Canada and Ireland, the population tended to stay near the coast, along the border with New Hampshire and in the lower third of the state.

Maine did not become a separate state until 1820 and from 1667 until 1780 was part of the province of Massachusetts. Between 1780 and 1820 it was a separate county and was referred to as as the district of Maine in Massachusetts. Historical records, especially early census from 1790 on, are often grouped by the Maine State Archives for research purposes under the state of Maine from 1780.

Birth, marriage and death records were not well kept by most towns until well into the 1800s and after Maine became a state, although a handful exist from the 1600s and 200 towns were keeping reasonable records by the 1700s. Marriage records were more likely to be maintained than birth and death records. Town clerks maintained the records but were not required to send copies to the secretary of state, as a central authority, until 1864. It was not until 1892 that the newly created State Board of Vital Statistics was established and the reporting of birth, marriage and death records became mandatory. Records from 1892 to 1922 are held by the Maine State Archives and after 1822 by the Office of Vital Statistics.

Most of the existing early Town Clerk records for the various townships in Maine before 1892 were filmed by the Mormons in the 1950s. In the 1920's, the State requested copies of pre-1892 vital records from the towns but only about 20 percent responded.  Those are called "delayed vital records" and these have also been filmed by the LDS.

Marriage records may also include 'Intention to Marry' records (similar to banns) requiring 3 weeks notice of intention to marriage. These may be published in the township of one partner in the marriage whilst the actual marriage may be recorded in the township of the other. Birth and death records may be grouped under the name of the current head of the household when the records were created. The dates of birth or death of family members may or may not mean that they occurred in the township where the family group was recorded.

Churches maintained their own records, especially the largest denomination, the Congregational Church, followed by the Baptists, Universalists and the Quakers. Few of these records have been published or filmed. However, whether the marriage ceremony was performed by a civil or a church authority, local laws required the marriage to be recorded in civil records. If the marriage was performed by someone other than the town clerk, such as a minister or justice of the peace, that person was required to report, or "return" the marriage information to the town or county clerk.
