PROBATE SENECA STERRY
[LANSINGBURGH, 1886]

 

The last Will and Testament of Seneca E. Sterry late of the town of Lansingburgh in the county of Rensselaer deceased together with the proofs thereof as a will of real and personal estate. Recorded April 5th 1886

I Seneca E Sterry of the village of Lansingburgh in the county of Rensselaer and state of New York make this my last Will as follows, that is to say, I give, devise and bequeath all of my estate and property, real and personal, of every name and nature, to my wife Louisa A. Sterry, her heirs and assigns. And I hereby appoint my said wife Louisa A. Sterry of Lansingburgh N.Y. Executrix, and my brother in law William Bradshaw of the same place Executor of this my will revoking any former will by me made. In witness whereof I have signed and sealed, published and declared this instrument as my will at Lansingburgh aforesaid, this 28th day of November A.D. 1874

The said Seneca E. Sterry at Lansingburgh aforesaid, on said 28th day of November 1874 signed and sealed this instrument and published and declared the same as and for his last will and we at his request, and in his presence, and in the presence of each other, have hereunto written our names as subscribing witnesses.

Surrogate Court
In the matter of proving the will and testament of Seneca E Sterry, deceased, County of Rensselaer Eugene Hyatt & Albert C Comstock of the village of Lansingburgh N.Y. in the County of Rensselaer, being sworn in open court doth depose and say and each for himself says he is a subscribing witness to the last will and testament of Seneca E Sterry late of Lansingburgh in the County of Rensselaer deceased and that the said Seneca E Sterry did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents and which purports  to be the last will and testament of the said Seneca E Sterry which bears date on the 28th day of November 1874.  And that the said Seneca E Sterry did at the time of subscribing his name aforesaid declare the said instrument to be his last will and testament and these deponents did thereupon subscribe their names at the end of the said will as attesting witnesses thereto at the request of the said testator in his presence and in the presence of each other. And at the time when the said testator subscribed his name as aforesaid he was of sound mind and memory of full age to execute a will and was not under any restraint but competent in all respects to devise real estate.

At a Surrogate Court held in and for the County of Rensselaer at the Surrogate’s Office in the City of Troy in said County on the 5th day of April 1886
Present William Lord, Surrogate in the matter of the last Will and Testament of Seneca E Sterry deceased.

On reading and filing due proof of the service of the citation herein on the parties therein named and upon due proof of the execution of the paper propounded or the last will and testament of Seneca E Sterry late of the town of Lansingburgh in said County deceased bearing date on the 28th day of November 1874 and Louisa A. Sterry Executrix named in said will and widow of said deceased appearing and it appearing by such proofs that the said will was duly executed; that the testator at the time of executing the same was of full age for making a will, was of sound mind and memory and not under restraint,  and in all respects competent to devise real estate and the probate thereof not having been contested, it is ordered adjudged and decreed that the said paper purporting to be the last will and testament of said Seneca E. Sterry deceased is his last will and testament and was duly executed to pass real and personal estate and that the same bed admitted to probate as a will of real and personal estate and recorded as such with the proofs taken as aforesaid.
