PROBATE MARINA STERRY
[LANSINGBURGH, NEW YORK, 1888]

 

The last Will and Testament of Marina Sterry of the Village of Lansingburgh in the County of Rensselaer and State of New York. I Marina Sterry of the Village of Lansingburgh in the County of Rensselaer make and publish this my last Will and Testament as follows. I give devise and bequeath to my six nieces viz: Marietta Neal, Harriet L. Gaston, Lucy A. Orcutt, Mary L Smith, Emily H Williams and Mariah Lyons or their heirs all of my personal property share and share alike. And I appoint my nephew Milton S Bradshaw Executor of this my last will revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this 23d day of January A D 1886.                                                - Marina Sterry

The foregoing instrument was at the date thereof signed, sealed, published and declared by the said Marina Sterry as and for her last will and testament in presence of and who at her request and in her presence and in the presence of each other have subscribed our names as witnesses.

Surrogate Court
In the matter of proving the Will and Testament of Marina Sterry deceased, County of Rensselaer as
David H Flack and Howard S Dickson of the Village of Lansingburgh in the County of Rensselaer being sworn in open court doth depose and say and each for himself says that he is a subscribing witness to the last will and testament of Marina Sterry late of Lansingburgh in the county of Rensselaer deceased and that the said Marina Sterry did in the presence of these deponents subscribe her name at the end of the instrument which is now shown and exhibited to these deponents and which purports to be the last will and testament of the said Marina Sterry which bears date on the 23d day of January 1886 and that the said Marina Sterry did at the time of subscribing her name aforesaid declare the said instrument to be her last will and testament and these deponents did thereon subscribe their names at the end of the said will as attesting witnesses thereto at the request of the said testatrix in her presence and in the presence of each other and at the time when the said testatrix subscribed her name as aforesaid she was of sound mind and memory of full age to execute a will and was not under any restraint but competent in all respects to devise real estate.

  • Sworn statement by John S Hyatt dated 14 Apr 1888 that he posted a copy of this citation to William D Sterry of Kansas City Missourt; Harriet L Gaston of West Stockbridge Massachusetts; Lucy A Orcutt of Ann Arbor Michigan; John Sterry of East Boston Massachusetts; and Albert Sterry of Elgin Ontario; and a further statement that he personally served the citation on Emily H Williams, Mary L Smith &William Sterry at the village of Lansingburgh and on Marietta S Neal and Urwin D Sterry at the city of Troy and on Edwin S Sterry at the city of Albany
  • A signed statement to the Surrogate's Court by David H Flack and Howard S Dickson stating that they witnessed the will
  • A signed statement by one of the publishers of THE LANSINGBURG COURIER that a notice of the probate of Marina's will was published for six successive weeks prior to the reading of the will
